Construction Claims & Risk Management

Facts, schedules
and dollars, documented.

Claim development, delay and impact analysis, and construction risk management for owners and contractors.

Construction disputes are usually won on documentation rather than on argument. The party with the maintained schedule, the contemporaneous records and the analysis that follows an accepted methodology tends to prevail, largely independent of who was morally right.

Development and defence

Claims are prepared for parties who believe they are owed time or money, and analysed for parties on the receiving end. The methodology is identical, which is the only way either version is credible.

Delay analysis

The central question is almost always whether a given delay actually affected the critical path, and whether concurrent delays existed. That is a schedule analysis, and it depends on the quality of the schedule record, which is why the scheduling and claims services belong together.

Risk management before the dispute

The cheaper version of all of this is managing risk during the project. Identifying exposure, keeping records that would survive scrutiny, and giving notice properly and on time. Most claims that fail, fail on notice.

Services

  • Claim development for time and cost entitlement
  • Claim analysis and response where you are the recipient
  • Delay and time impact analysis using the schedule record
  • Concurrent delay assessment
  • Cost and damages quantification
  • Changed and differing site condition evaluation
  • Construction risk management during the project, before it becomes a claim

Common Questions

Straight answers

Do you work for owners or contractors?

Both. The analysis method does not change with the client, and an analysis that only works for one side does not survive being tested.

What do you need from us to start?

The contract, the baseline schedule, schedule updates, correspondence and any notices given. The quality of the record largely determines the strength of the position.

We never updated our schedule. Is the claim dead?

Not necessarily, but it is harder and the analysis becomes reconstruction from other contemporaneous records. It is the single most common reason a legitimate claim struggles.

Can you help before it becomes a formal dispute?

Yes, and that is by far the better time. Risk management during the project, including getting notice right, prevents more loss than any claim recovers.

Something on this project is going sideways.

Get the record and the analysis in order now, while the evidence is still contemporaneous.
